Welcome to Provenir by Merria Dearman. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to Provenir. We operate this website and all related services, including the information, content, features, tools, products, and services provided to you (collectively, the “Services”), in order to deliver a curated, high quality client experience.

Our store is hosted on Shopify, which enables us to provide our products and services to you.

These Terms of Service (“Terms”) govern your access to and use of our Services, including all purchases made through our website. Please read them carefully, as they contain important information regarding your legal rights, including limitations of liability and disclaimers.

By accessing, browsing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you represent that you are at least the age of majority in your jurisdiction, or that you have provided consent for any minor dependents to use the Services under your supervision.

You may be required to provide personal information such as your name, email address, billing details, shipping information, and payment credentials to access certain features or complete a purchase. You agree that all information provided is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account and for all activity conducted under it. Accounts may not be transferred, assigned, or sold to any third party.

SECTION 2 – PRODUCTS AND SERVICES

We strive to present our wigs, hairpieces, and services as accurately as possible. However, variations in color, texture, and overall appearance may occur due to screen settings, lighting conditions, and the handcrafted nature of our products.

We do not guarantee that products will appear exactly as displayed or meet subjective expectations. All product descriptions, pricing, and availability are subject to change at any time without notice.

We reserve the right to limit, modify, or discontinue any product or service at our sole discretion.

Additional styling services, including but not limited to highlighting, low lighting, perming, cutting, or advanced finishing, are not included unless explicitly stated and may incur additional charges.

SECTION 3 – ORDERS, DEPOSITS, AND ACCEPTANCE

All orders placed through our website constitute an offer to purchase. Provenir reserves the right to accept or decline any order at its sole discretion.

Orders are not confirmed until payment has been successfully processed and acceptance has been issued. Once an order is placed, modifications or cancellations may not be accommodated.

All deposits are non refundable. Production will not begin until the required deposit has been received.

All sales are final. No refunds, returns, or exchanges will be issued under any circumstances.

SECTION 4 – PRICING, PAYMENT, AND PICKUP

For bespoke pieces, unless hand delivered by Provenir or shipped directly, the remaining balance is due in full at the time of pickup or delivery.

For all online orders, payment is required in full at the time of purchase.

Once the client has been notified that the wig or hairpiece is complete, it must be picked up within ninety (90) days. If the remaining balance is not paid and the item is not collected within this timeframe, Provenir reserves the right to charge storage fees and/or deem the piece forfeited, at which point ownership of the item will revert to Provenir at its sole discretion.

All prices are subject to change without notice. The price charged will be the price displayed at the time the order is placed. Prices do not include applicable taxes, shipping, or handling fees unless otherwise stated. The client agrees to provide accurate and complete payment information and authorizes all charges incurred.

SECTION 5 – SHIPPING, DELIVERY, AND PRODUCTION TIMELINES

All delivery and completion dates provided are estimates only and are not guaranteed.

Due to the custom, handcrafted nature of our work, the time required to complete a wig or hairpiece to Provenir’s quality standards may exceed the originally estimated timeframe.

Provenir is not liable for delays resulting from craftsmanship standards, material availability, supplier timelines, or necessary refinements required to achieve the intended quality and specifications of the final product.

Additionally, services are performed by skilled professionals and are subject to reasonable delays arising from personal circumstances, health considerations, family obligations, or other unforeseen life events. Such delays do not constitute a breach of contract and do not entitle the client to a refund, discount, chargeback, or cancellation of the order.

Provenir remains committed to completing all orders in a professional and timely manner while prioritizing quality, safety, and craftsmanship.

All delivery timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or circumstances beyond our control.

Risk of loss transfers to you once your order has been delivered to the shipping carrier.

SECTION 6 – ADJUSTMENTS POLICY

Clients with custom orders have thirty (30) days from the date of delivery to request adjustments.

Up to two (2) complimentary adjustments will be provided if deemed reasonable and within the original scope of the order. Any additional adjustments or changes beyond this scope may incur additional fees.

SECTION 7 – CONSULTATION FEES

Consultations with Merria are subject to a one time, non refundable $500 consultation fee.

This fee will be applied toward the purchase of a wig or hairpiece if an order is placed within thirty (30) days of the consultation date.

SECTION 8 – INTELLECTUAL PROPERTY

All content associated with Provenir by Merria Dearman, including but not limited to branding, imagery, product designs, text, graphics, and media, is the exclusive property of Provenir and is protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, or used without prior written consent.

SECTION 9 – THIRD PARTY SERVICES AND TOOLS

We may provide access to third party tools or services. These are offered “as is” and “as available,” without warranties or guarantees of any kind. Your use of such tools is at your own risk.

SECTION 10 – PRIVACY

Your submission of personal information is governed by our Privacy Policy [LINK]. By using our Services, you acknowledge and agree to these practices.

SECTION 11 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Provenir shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services or products.

All products and services are provided “as is” and “as available,” without warranties of any kind, express or implied.

SECTION 12 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Provenir, its affiliates, and service providers from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

SECTION 13 – RIGHT TO REFUSE SERVICE

Provenir reserves the right to refuse service to any individual at its sole discretion.

SECTION 14 – TERMINATION

We reserve the right to suspend or terminate your access to the Services at any time, without notice, if these Terms are violated.

SECTION 15 – GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Provenir operates.

SECTION 16 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of the Services following any changes constitutes acceptance of those changes.
